SCOTUS Backs Muslim Travel Ban; Critics Liken It to Decisions on Segregation & Japanese Internment

27 June 2018

In a series of extraordinary legal decisions Tuesday, the Supreme Court has upheld President Trump’s so-called Muslim travel ban, and a federal judge in San Diego has ruled immigration officials must stop separating immigrant children from their parents at the border and must reunite all parents and children within 30 days.

On Tuesday, the Supreme Court ruled 5 to 4 to uphold Trump’s travel ban, which prohibits people from entering the United States from five majority-Muslim countries—Iran, Libya, Yemen, Syria and Somalia—as well as people from North Korea and some government officials from Venezuela.

In a scathing dissent, Justice Sonia Sotomayor condemned the ban as “harrowing” and said it was “motivated by hostility and animus toward the Muslim faith.” She also said the decision to uphold the ban involved “ignoring the facts, misconstruing our legal precedent and turning a blind eye to the pain and suffering the proclamation inflicts upon countless families and individuals, many of whom are United States citizens.”

After the ruling was announced, protesters gathered outside the Supreme Court to condemn the decision. We speak to Lee Gelernt, deputy director of the ACLU Immigrants’ Rights Project; Linda Sarsour of MPower Change; and Diala Shamas of the Center for Constitutional Rights.

The new Dred Scott: Supreme Court upholds Trump travel ban

27 June 2018

The US Supreme Court’s decision in Trump v. Hawaii upholding President Trump’s anti-Muslim travel ban is a shameful landmark in the destruction of democratic rights. It has been met with contempt and outrage by tens of millions of Americans and countless more millions around the world.

In its legal, political and moral bankruptcy, the decision ranks alongside such infamies as Korematsu v. United States, which upheld the internment of Japanese-Americans, Plessy v. Ferguson, which sanctioned racial segregation, and Dred Scott v. Sandford, which held that the descendants of black Africans brought here as slaves, even when freed, could not be citizens and “had no rights which the white man was bound to respect.”

By upholding Trump’s power to seal the country’s borders, the court has granted the president limitless authority to enact his fascistic policies against immigrants and political opponents. There can now be little question that the country’s highest court will rubber-stamp whatever authoritarian measures Trump plans on enacting, including the abolition of due process for immigrants and the erection of concentration camps.

A comment by Belgian daily De Standaard on this decision is here.

The US Supreme Court yesterday ruled in favor of the “free speech” rights of anti-abortion advocates who operate misleading “crisis pregnancy centers.” The justices, by a vote of 5 to 4, struck down a California law that would require these fake clinics to inform women of the availability of public programs that provide contraception and abortion services for free or at a low cost. This decision is yet another victory for Christian fundamentalists and the campaign to use “freedom of religion” to undermine the separation of church and state, legalize discrimination, and obstruct access to health care: here.

Supreme Court Justice Anthony Kennedy announced Wednesday that he will retire from the bench on July 31, giving Donald Trump the opportunity to dramatically shift the country’s highest court even further to the right for years to come: here.

FIGHT, DEMS! Senate Democrats must hold strong (and peel off one Republican) to stop Majority Leader Mitch McConnell from holding a pre-midterm vote to confirm another Trump Supreme Court nominee following Justice Anthony Kennedy’s retirement announcement. Should Trump get his pick, a new conservative justice is likely to have an impact on reproductive rights for decades, with CNN’s Jeffrey Toobin predicting that abortion will be illegal in 20 states within 18 months. Gun control will also be hit, while LGBTQ rights — including the right to marry — face devastation. This is what the rule of the minority looks like, summed up in three words by the New York Daily News. [HuffPost]

SCOTUS GUTS LABOR MOVEMENT The current Supreme Court (not the one rigged with another Trump pick) on Wednesday delivered a sweeping blow to the labor movement, ruling that public sector workers represented by unions cannot be required to pay any union dues. [HuffPost]

PACK THE COURT! “The Supreme Court, Congress and the executive branch are instruments of political power. All three are currently being used to advance the ideology and agenda of international fascism.” Read our explainer on why Democrats must pack the court. [HuffPost]

A POST-ROE WORLD This reproductive rights activist explains what to do when ― not if ― the Supreme Court overturns the federal right to a legal abortion. And here’s our primer on what a post-Roe world looks like. [HuffPost]

BREXIT PARTY LEADER EXCUSES TRUMP’S P***Y REMARK During a debate among Britain’s party leaders ahead of its upcoming election, Nigel Farage excused Trump’s infamous boast about grabbing women “by the p***y.” Farage downplayed Trump’s comments as the kind of “dreadful things” men sometimes say after drinking. Trump doesn’t drink.  [HuffPost]

  1. A few moments ago, Justice Anthony Kennedy announced his retirement from the Supreme Court.

As you well know, this Supreme Court vacancy puts issues that affect every single American in the balance — from a woman’s right to choose to equal rights under the law to privacy and our civil rights.

Given the high stakes of this seat, which I believe will determine the fate of many fundamentally protected constitutional rights, the American people should have a say in this decision.

The midterms are in just four months. We cannot and we should not vote on a nominee until after the American people have a chance to make their voices heard at the ballot box.

I’m organizing an urgent petition telling Majority Leader Mitch McConnell we must not vote to fill this seat until Americans have voted at the ballot box. Make your voice heard by adding your name.

We’ve already seen the President’s list of potential SCOTUS nominees and they are non-starters. The American people deserve a Supreme Court justice who will fight to protect your rights, not conservative ideologues.

I will not sit back and accept them to serve on the highest court in the land — and I hope you won’t either.

Please add your name to my petition telling Mitch McConnell we must not vote to fill this seat until Americans have voted at the ballot box.

I know from personal experience — as a prosecutor and as a beneficiary of the landmark Brown vs. Board ruling desegregating our nation’s schools — that the decisions handed down by the court touch every aspect of our lives. The stakes don’t get any higher. Americans must be heard.

    Thanks for all you do.

  3. THIS IS AN EMERGENCY. Supreme Court Justice Anthony Kennedy just announced his retirement. He was the deciding vote to preserve Roe v. Wade and a woman’s right to safe, legal abortion.1

If the Senate confirms another extreme anti-choice judicial appointment from Donald Trump, women could lose their right to choose. Really.

We’re launching a major offensive to stop the Senate from voting on Trump’s Supreme Court pick and save Roe v. Wade. Will you chip in $5?

Justice Kennedy has been the critical swing vote on case after case–from abortion rights to marriage equality and discrimination against LGBTQ people.

If he is replaced with an anti-choice, anti-science extremist handpicked by the far right-wing, it could set back human rights and equality for a generation or more. It could spell the end of Roe v. Wade.

This is not a theoretical threat: Multiple states have been preparing just for this moment. Iowa passed a six-week abortion ban for the express purpose of challenging Roe v. Wade at the Supreme Court.2

GOP leader Mitch McConnell was ready for Kennedy’s announcement: He’s already got an August session planned. He wants to jam through a vote on Trump’s pick before the mid-term elections.

There is a set of key swing Senators, like pro-choice Republicans Collins/Murkowski, as well as a few Democrats, who we need to convince. We’ve done it before and we can do it again.

We’ve got to mobilize a ground force of activists to tell their stories to Congress like never before. We’ve got to ensure Democrats stick together. We’ve got to amplify the voices of 7 in 10 Americans who support a woman’s right to choose. And we need your help.

Will you chip in $5 to stop the extreme right-wing from taking over the Supreme Court and overturning Roe v. Wade?

    Thank you for stepping up.

  4. The ideals of our democracy are on the line

Today, Justice Kennedy announced his retirement from the Supreme Court after 30 years of service, leaving a critical vacancy.

This is a monumental moment for our country. The very integrity of our justice system and the rule of law will be affected by the confirmation of a new justice to the Supreme Court. We have seen the judges that President Trump has advanced for lower courts. We have seen the extreme jurisprudence of Justice Gorsuch – who was President Trump’s first nominee for the Court. We can have no confidence that President Trump will present a nominee with a record of commitment to racial equality and justice. And so every American must invest themselves in ensuring that Congress does its job – which, in this case, means not considering any nominee this year, and voting down any nominee who does not represent the ideals of our democracy or is otherwise unqualified to serve on the highest court in our nation. It is critical that Congress fight for the American people in the process of addressing this open seat on the Court.

There may be no term in recent history that demonstrates the importance of the Court’s composition more than the one that just concluded in which Ohio was allowed to proceed with a process to purging voters for failing to vote; Texas was allowed to proceed with electoral maps that were deemed intentionally discriminatory; workers’ rights to challenge workplace violations, as well as the ability for unions to support their work to protect all workers were overruled; and anti-Muslim bigotry was affirmed.

We also wish to recognize Justice Anthony Kennedy for his 30 years of service on the Supreme Court. He has been an important moderating force on issues ranging from LGBT rights, to abortion, and affirmative action, and has spoken powerfully and eloquently in defense of the dignity of every American. His voice on the Court will be missed.

In the addressing the vacancy left by Justice Kennedy, the Senate must use its “advise and consent” power to ensure our nation is served by a justice who will uphold the rule of law and equal rights for all Americans. The Supreme Court is the institution that protects the rule of law in our country. We must protect the Supreme Court.

Please contact your U.S. Senators at (202) 224-3121 and demand that the incoming Senate, which Americans will vote in this November, be given the opportunity to vote on confirmation of the next Supreme Court justice.

    With you in struggle,

We are launching a new, national organization to amplify the struggles of im/migrants and refugees everywhere. We believe in supporting the leadership of these movements by connecting all of the issues facing workers here, whether it is police terrorism against communities of color, mass incarceration, sexism, ableism, or exploitation, we want to support a broad movement to take direct action against the horrific crimes of ICE and the Border Patrol.

We will be traveling to Brownsville, Texas from June 27 – to July 2 to support actions and take part in an eyewitness tour against U.S. concentration camps for migrant youth and families. We need your support to bring a group of activists to learn about the conditions on the frontlines of this movement. The delegation will publish reports and findings from the border, as well as participating in demonstrations led by these communities against the ongoing separation of families in these cruel concentration camp style detention centers.

Once we return from Texas, we will be speaking out, organizing, and shutting down ICE across the country in support of this growing resistance movement. We need your support to make this important work happen!

  6. The Supreme Court is the most important judicial body in the country. The decisions it reaches impact all Americans, even the ones that end up five votes to four.

Since the confirmation of Justice Neil Gorsuch, the court has taken a radical rightward turn. In the past 72 hours alone, it sided with big money interests against working people in an effort to destroy the union movement in this country. And it affirmed the president’s Muslim ban and chose fear, racism and xenophobia over the American ideals of religious freedom and tolerance.

Those decisions, both 5-4 votes, were only possible because of the unprecedented actions of Senate Majority Leader Mitch McConnell to deny President Obama’s nominee a vote ahead of the 2016 elections. He did it because, in his own words, “The American people should have a voice in the selection of their next Supreme Court Justice.”

Now that Justice Kennedy will retire at the end of July, Mitch McConnell should remember those words. And our job right now is to make sure he does, and to make it clear the American people want a say in Justice Kennedy’s replacement.

Please sign my petition: Tell the U.S. Senate that there should not be a vote on any potential Supreme Court justice until after the American people have had a chance to vote in November and a new Senate is sworn in next January.

The truth is, the American people deserve a Supreme Court justice who respects the rights of workers instead of bowing down to big business. At a time of massive income and wealth inequality in this country, we need a court that will protect workers’ rights and not just concern itself with corporate profits.

The American people deserve a Supreme Court that will move us back in the direction of one person, one vote and stop our slide into an oligarchy, in which the political life in this country is increasingly controlled by a handful of billionaire families. I fear that President Trump’s next Supreme Court nominee would take the disastrous Citizens United decision even further by supporting the elimination of all restrictions on campaign finance, effectively allowing billionaires to contribute unlimited sums to candidates.

We also cannot risk a Supreme Court that would put in jeopardy the privacy rights of all Americans and a woman’s right to control her own body. Reproductive rights in this country are at risk. Despite overwhelming opposition from the American people I believe there is a very strong chance President Trump’s next nominee would vote to overturn Roe v. Wade. We cannot allow that to happen.

The Supreme Court also recently sided with those who want to make it harder for people to vote. In the year 2018, it should not be too much to ask for people to be able to vote without harassment. Our job should be to make it easier for people to participate in the electoral process, not harder.

Now, the Koch brothers immediately pledged to spend more than seven figures pressuring Democrats into supporting President Trump’s nominee.

This time, we must be united from the start that there can be no vote on ANY nominee until the American people have had their chance to make their voices heard.

I believe most Americans want a Supreme Court that will stand up for civil liberties, constitutional rights, workers’ rights, environmental rights and women’s rights.

By now we know that is not what we will get from Donald Trump’s nominee. And I believe the American people have a right to make their voices heard about that at the ballot box in November.
