SCOTUS Backs Muslim Travel Ban; Critics Liken It to Decisions on Segregation & Japanese Internment

In a series of extraordinary legal decisions Tuesday, the Supreme Court has upheld President Trump’s so-called Muslim travel ban, and a federal judge in San Diego has ruled immigration officials must stop separating immigrant children from their parents at the border and must reunite all parents and children within 30 days.
On Tuesday, the Supreme Court ruled 5 to 4 to uphold Trump’s travel ban, which prohibits people from entering the United States from five majority-Muslim countries—Iran, Libya, Yemen, Syria and Somalia—as well as people from North Korea and some government officials from Venezuela.
In a scathing dissent, Justice Sonia Sotomayor condemned the ban as “harrowing” and said it was “motivated by hostility and animus toward the Muslim faith.” She also said the decision to uphold the ban involved “ignoring the facts, misconstruing our legal precedent and turning a blind eye to the pain and suffering the proclamation inflicts upon countless families and individuals, many of whom are United States citizens.”
After the ruling was announced, protesters gathered outside the Supreme Court to condemn the decision. We speak to Lee Gelernt, deputy director of the ACLU Immigrants’ Rights Project; Linda Sarsour of MPower Change; and Diala Shamas of the Center for Constitutional Rights.

The US Supreme Court’s decision in Trump v. Hawaii upholding President Trump’s anti-Muslim travel ban is a shameful landmark in the destruction of democratic rights. It has been met with contempt and outrage by tens of millions of Americans and countless more millions around the world.
In its legal, political and moral bankruptcy, the decision ranks alongside such infamies as Korematsu v. United States, which upheld the internment of Japanese-Americans, Plessy v. Ferguson, which sanctioned racial segregation, and Dred Scott v. Sandford, which held that the descendants of black Africans brought here as slaves, even when freed, could not be citizens and “had no rights which the white man was bound to respect.”
By upholding Trump’s power to seal the country’s borders, the court has granted the president limitless authority to enact his fascistic policies against immigrants and political opponents. There can now be little question that the country’s highest court will rubber-stamp whatever authoritarian measures Trump plans on enacting, including the abolition of due process for immigrants and the erection of concentration camps.

The US Supreme Court yesterday ruled in favor of the “free speech” rights of anti-abortion advocates who operate misleading “crisis pregnancy centers.” The justices, by a vote of 5 to 4, struck down a California law that would require these fake clinics to inform women of the availability of public programs that provide contraception and abortion services for free or at a low cost. This decision is yet another victory for Christian fundamentalists and the campaign to use “freedom of religion” to undermine the separation of church and state, legalize discrimination, and obstruct access to health care: here.

The ideals of our democracy are on the line
Today, Justice Kennedy announced his retirement from the Supreme Court after 30 years of service, leaving a critical vacancy.
This is a monumental moment for our country. The very integrity of our justice system and the rule of law will be affected by the confirmation of a new justice to the Supreme Court. We have seen the judges that President Trump has advanced for lower courts. We have seen the extreme jurisprudence of Justice Gorsuch – who was President Trump’s first nominee for the Court. We can have no confidence that President Trump will present a nominee with a record of commitment to racial equality and justice. And so every American must invest themselves in ensuring that Congress does its job – which, in this case, means not considering any nominee this year, and voting down any nominee who does not represent the ideals of our democracy or is otherwise unqualified to serve on the highest court in our nation. It is critical that Congress fight for the American people in the process of addressing this open seat on the Court.
There may be no term in recent history that demonstrates the importance of the Court’s composition more than the one that just concluded in which Ohio was allowed to proceed with a process to purging voters for failing to vote; Texas was allowed to proceed with electoral maps that were deemed intentionally discriminatory; workers’ rights to challenge workplace violations, as well as the ability for unions to support their work to protect all workers were overruled; and anti-Muslim bigotry was affirmed.
We also wish to recognize Justice Anthony Kennedy for his 30 years of service on the Supreme Court. He has been an important moderating force on issues ranging from LGBT rights, to abortion, and affirmative action, and has spoken powerfully and eloquently in defense of the dignity of every American. His voice on the Court will be missed.
In the addressing the vacancy left by Justice Kennedy, the Senate must use its “advise and consent” power to ensure our nation is served by a justice who will uphold the rule of law and equal rights for all Americans. The Supreme Court is the institution that protects the rule of law in our country. We must protect the Supreme Court.

Who is FIRE?
FIRE is a new organization started by activists across the USA.
Here are a few of our founding organizers:
Rahui Suré Saldivar-Soto is an organizer and activist in San Diego. They are transgender and two spirit and have been fighting for liberation since 2015.
Samuel Ordóñez is a Boston-based activist whose family fled state-sanctioned violence during the Guatemalan Civil War. Dedicated anti-imperialist and pan-Americanist.
Teresa Gutierrez has been fighting for working class rights for decades; is a co-founder of the May 1st Coalition for Worker & Immigrant Rights and is originally from Texas.
John Parker, based in Los Angeles, is a long-time socialist who recently ran in California as the Peace and Freedom Party’s 2018 candidate for U.S. Senate.
He traveled and written extensively as an anti-imperialist, anti-war activist, as well as being a long-time and well-known fighter against racism, police terror,
for im/migrant and workers rights.
Gloria Rubac is a Houston-based activist started her work supporting the Black Panther Party in Houston and has been active for decades part in many struggles, including anti-imperialist work, as well as spending years of her life fighting to abolish the death penalty in Texas. Gloria is also part of the Migrant Rights Collective and has been active in the im/migrants rights struggle since the 1970s.

The Supreme Court is the most important judicial body in the country. The decisions it reaches impact all Americans, even the ones that end up five votes to four.
Since the confirmation of Justice Neil Gorsuch, the court has taken a radical rightward turn. In the past 72 hours alone, it sided with big money interests against working people in an effort to destroy the union movement in this country. And it affirmed the president’s Muslim ban and chose fear, racism and xenophobia over the American ideals of religious freedom and tolerance.
Those decisions, both 5-4 votes, were only possible because of the unprecedented actions of Senate Majority Leader Mitch McConnell to deny President Obama’s nominee a vote ahead of the 2016 elections. He did it because, in his own words, “The American people should have a voice in the selection of their next Supreme Court Justice.”
Now that Justice Kennedy will retire at the end of July, Mitch McConnell should remember those words. And our job right now is to make sure he does, and to make it clear the American people want a say in Justice Kennedy’s replacement.
Please sign my petition: Tell the U.S. Senate that there should not be a vote on any potential Supreme Court justice until after the American people have had a chance to vote in November and a new Senate is sworn in next January.
The truth is, the American people deserve a Supreme Court justice who respects the rights of workers instead of bowing down to big business. At a time of massive income and wealth inequality in this country, we need a court that will protect workers’ rights and not just concern itself with corporate profits.
The American people deserve a Supreme Court that will move us back in the direction of one person, one vote and stop our slide into an oligarchy, in which the political life in this country is increasingly controlled by a handful of billionaire families. I fear that President Trump’s next Supreme Court nominee would take the disastrous Citizens United decision even further by supporting the elimination of all restrictions on campaign finance, effectively allowing billionaires to contribute unlimited sums to candidates.
We also cannot risk a Supreme Court that would put in jeopardy the privacy rights of all Americans and a woman’s right to control her own body. Reproductive rights in this country are at risk. Despite overwhelming opposition from the American people I believe there is a very strong chance President Trump’s next nominee would vote to overturn Roe v. Wade. We cannot allow that to happen.
The Supreme Court also recently sided with those who want to make it harder for people to vote. In the year 2018, it should not be too much to ask for people to be able to vote without harassment. Our job should be to make it easier for people to participate in the electoral process, not harder.
Now, the Koch brothers immediately pledged to spend more than seven figures pressuring Democrats into supporting President Trump’s nominee.
This time, we must be united from the start that there can be no vote on ANY nominee until the American people have had their chance to make their voices heard.
