Advocates for impeachment can take some measure of encouragement not just from the 85 cities and towns and 14 state Democratic parties that have passed impeachment resolutions, or the 11 state legislatures that have introduced them (Maine was #11 on Tuesday), but also from comments made Tuesday evening in Detroit by House Judiciary Committee Chairman John Conyers.

For about a year now there have been two Congressmen Conyers, the defender of our Constitution and the follower of Nancy Pelosi in her ban on impeachment.

Citizens in Detroit organized a town hall forum on impeachment and invited the Congressman.

Both John Conyerses came on Tuesday, and they both left partway through the event.

But, judging by the Associated Press story, Conyers the impeachment advocate was winning the internal battle.

    Whatever one may think of it, a general groundswell for the impeachment of Dick Cheney and George W. Bush is unmistakably afoot and is growing in this land.

    That is a GOOD thing. It is what the founders envisioned. It is what they hoped for. They saw “impeach” as a GOOD word, and they would want us to USE IT.

    As in a JUST war (as opposed to the current one), the issues at stake now far TRANSCEND partisan politics.

    I haven’t wanted to say this. In fact, it nauseates me, but we must very soberly face this. It’s not going to go away. We can no longer delay dealing with the horrible REALITY that, as a nation, we are in a crisis of Constitutional SURVIVAL. We will be deciding whether we want to continue as the free republic that we THINK that we are, because this CRISIS jeopardizes ALL other forms of “freedom” or “security” that we actually have or hope to keep.

    What “terrorist” could do more?

    Look friends, the Democrats are just going to have to ADAPT to running for election in ’08 while the dreadful but NECESSARY business of holding Cheney-Bush to account is conducted. No, this is NOT foremostly a political issue, it is a CONSTITUTIONAL issue. All partisan considerations must stem FROM it – not lead it. Impeachment hearings are an OPPORTUNITY to provide this nation with a sorely needed EDUCATION about what is going on and what our system is supposed to be. It is, in fact, actually about whether we will EVEN HAVE a Constitution for our government and it’s people (Yes, it is THAT serious!), which makes everything else possible (including elections). As for politics, I believe it is just as likely that this would HELP any worthwhile Democratic candidates as much as it could hurt them, while the abundantly manifest crimes of this administration are AIRED and CHECKED, as they MUST be.

    AND – even if our next president is a Democrat, I do not want them to have the kind of unchecked power that is claimed by this administration – and neither should you.

    (My Comment: This is not intended as jumping on the Democrats in Congress. It is just a small SAMPLE of a discussion that goes so much DEEPER than that. If anything, it underscores that we need to EMPOWER and embolden the Democrats by putting many MORE of them in office, to LIMIT the much more Constitution-hating Republicans …yet we also must expect Democrats to fulfill THEIR Constitutional responsibilities.)

    BILL MOYERS: But why is Congress supine?

    JOHN NICHOLS: They are supine for two reasons. One, they are politicians who do not– quite know how to handle the moment. And they know that something very bad happened on September 11th, 2001, now five years ago, six years ago. And they don’t know how to respond to it. Whereas Bush and Karl Rove have responded in a supremely political manner to it and, frankly, jumped around them. That’s one part of the problem.

    BILL MOYERS: Jumped around Congress?

    JOHN NICHOLS: Jumped around Congress at every turn. I mean, they don’t even tell them, they don’t consult with them. They clearly have no regard for the checks and balances. But the other thing that’s– in play here– and I think this is a– much deeper problem. I think the members of our Congress have no understanding of the Constitution. And as a result, they– don’t understand their CRITICAL role in the governance of the country.

    They– it– when the Republicans are in charge, they see their job as challenging– or as supporting the president in whatever he does, defending him, making it possible for him to do whatever he wants. When the Democrats are in charge, they seem to see their role as trying to score political points as opposed to what ought to be sort of a– common ground of–

    BILL MOYERS: –because the fact of the matter is approaching an– election year, you don’t really think, do you, that the Democrats want to experience a backlash by taking on a Republican president in an election-

    JOHN NICHOLS: Well, it–

    BILL MOYERS: –or that the Republicans want to impeach an administration that they elected in 2000 and reelected in 2004? There is a political element here, right?

    BRUCE FEIN: There’s always going to be a political element, Bill. But in the past, there’s always been a few statesmen who have said, “You know, the political fallout doesn’t concern me as much as the Constitution of the United States.” We have to keep that UNDEFILED throughout posterity ’cause if it’s not us, it will corrode. It will DISAPPEAR on the installment plan. And that has been true in the past. When we had during Watergate Republicans and remember Barry Goldwater, Mr. Republican, who approached the president and said, “You’ve got to resign.” There have always been that cream who said the country is more important than my party. We don’t have that anymore.

    BILL MOYERS: It seems to me the country is ahead of Congress on this. How do you explain all this talk about impeachment today out across the country?

    JOHN NICHOLS: People don’t want to let this go. They do not accept Nancy Pelosi’s argument that impeachment is, quote/unquote, off the table. Because I guess maybe they’re glad she didn’t take some other part of the Constitution off the table like freedom of speech. But they also don’t accept the argument that, oh, well, there’s a presidential campaign going on. So let’s just hold our breath till Bush and Cheney get done.

    When I go out across America, what I hear is something that’s really very refreshing and very hopeful about this country. An awfully lot of Americans understand what Thomas Jefferson understood. And that is that the election of a president does not make him a king for four years. That if a president sins against the Constitution– and does damage to the republic, the people have a right in an organic process to demand of their House of Representatives, the branch of government closest to the people, that it act to remove that president. And I think that sentiment is afoot in the land.

    BRUCE FEIN: …. And you have to have a certain vision, Bill. You have– you have to have a certain depth of conviction about philosophy and what the Constitution means, why those people died. They reached that last full measure of devotion, Cemetery Hill, Guatel Canal, Iwo Jima, the Battle of the Bulge, because there was something higher. You have to feel that in your body and your stomach cause you’ve mastered all those people who have sacrificed in the past and you know the danger of unchecked power ’cause you read history. You’re not a novice. There isn’t anybody in the Congress who’s able to do that because they don’t have that background. But they don’t have that temperament.

    JOHN NICHOLS: –there may be such people but their first step, their first step must be something that is very hard in these days of extreme partisanship and these days in money and politics and a media that doesn’t cover politics very well. Their first step has to be to say, “I cherish my country more than my party and more than the next election.” And so– probably. We’re talking about a DEMOCRAT.

    BILL MOYERS: –to take the lead?

    JOHN NICHOLS: And that Democrat’s first responsibility is to go to Nancy Pelosi, the speaker of the House, the person who decides what committee assignments they may have and even how nice an office they may get, and say, “You know, Nancy, I respect you. I respect you greatly, Mrs. Speaker. But the country’s more important. So you can– you can get mad at me. You can, you know, push back internally and whatever. But I’m going to the American people and I’m going to talk to them like Bruce Fein just did. Now, my sense is the response to the American people and, frankly, the response of a lot of other members of Congress would be to stand up and applaud. But you have to have that initial courage to do so.

  3. Call Congress Today for Impeachment

    We’ve reached the impeachment moment for Vice President Dick Cheney. We’ve pushed the cosponsor list for H. Res. 333 up to 14. Chairman John Conyers says that if we get 3 more he’ll begin the impeachment proceedings.

    And many Congress Members must be recognizing that there is no other path available. Cheney and Bush have repeatedly refused to comply with subpoenas, ordered former staffers not to comply, and announced that the Justice Department will not enforce contempt citations from Congress. When a special prosecutor attempted to hold this administration accountable, Cheney’s chief of staff obstructed justice, and Cheney persuaded Bush to commute his sentence. There is no course left for Congress but Impeachment.

    On Monday, July 23rd, the fifth anniversary of the meeting that produced the Downing Street Minutes, Cindy Sheehan, Ray McGovern, Rev. Lennox Yearwood, Ann Wright, Debra Sweet, Dave Lindorff, David Swanson, Jodie Evans, Medea Benjamin, Kevin Zeese, and Tina Richards will lead a march to Chairman Conyers office and not leave until he agrees to begin impeachment proceedings.

    If you cannot be there, you can take two minutes on Monday and do two things: phone Chairman Conyers at 202-225-5126 and ask him to start the impeachment of Dick Cheney; and phone your own Congress Member at 202-224-3121 and ask them to immediately call Conyers’ office to express their support for impeachment. Your Congress Member might be one of the three needed, not just to keep impeachment activists out of jail but to keep this nation from devolving into dictatorship.

  4. Conyers Wimps Out

    On Monday, Rep. John Conyers brushed off the heroic impeachment efforts of Cindy Sheehan, Rev. Lennox Yearwood, Ray McGovern, Medea Benjamin, David Swanson, 300 dedicated impeachment marchers, 1 million petition signers, resolutions from dozens of cities and towns, and activists who called his office every 30 seconds.

    His reasons? First, he doesn’t have the support of a majority of the House (218 votes) to impeach Bush or Cheney. Second, FOX News would attack him.

    These are simply not acceptable reasons to allow George Bush and Dick Cheney to commit war crimes and shred the Constitution – and we’re not going to accept them. Instead, we’re going to fight harder than ever for impeachment.

    Conyers doesn’t have 218 votes today, but we can change that. Tell your Representatives to join the 14 sponsors of H.Res. 333, Articles of Impeachment for Vice President Cheney:

    Gonzo Flames Out

    Even as Conyers wimped out, fate smiled upon us in the smirking face of of Alberto Gonzales, who is just so bad that even Republican Senators can barely stop themselves from screaming at him.

    Gonzales testified again today before the Senate Judiciary Committee to explain why he lied to them in his previous appearances. So what did Gonzales do? He lied and lied some more.

    Everyone who cares about Justice is outraged. The Senate is finally considering perjury charges. But if the Senate filed charges, guess who’d have to prosecute? Alberto Gonzales’ own utterly corrupt Justice Department!

    Impeachment is the only cure and it’s time for Congress to exercise it. Once they do, they will discover the American people support their efforts to hold Bush & Co. accountable. And an impeachment investigation into Abu Gonzo will lead directly to Cheney and Bush. He must know about some nasty skeletons – why else are they protecting him in the face of Republican outrage?

    Bush and Cheney have now surpassed Nixonian levels of disapproval. They have openly committed abuses for which the House Judiciary Committee passed articles of impeachment against Nixon, such as refusing to comply with subpoenas. They have openly violated laws put into place in response to Nixon’s abuses, such as the Foreign Intelligence Surveillance Act. They have siezed unconstitutional power in ways Nixon never attempted, by rewriting laws with signing statements. And Cheney and Bush have committed far more serious crimes, including misleading the nation into war, kidnapping, torture, and murder.

    When Congress finally stood up to Nixon, he was gone in 3 months. (And that was with evidence of crimes still needing to be discovered, unlike today when it is already known). The Democrats won the biggest victories in recent memory in the elections that followed their decision to uphold the Constitution. In contrast, when they took the impeachment of President Ronald Reagan off the table, in order to win elections, they proceeded to lose.

    Senator Graham:

    The reason for my correspondence is that you in the U.S. Congress
    have allowed the Bush regime to create a dysfunctional loony bin in
    Iraq. Your recent interview in the Charleston Post and Courier shows
    that in desperation you are a victim of doing the same thing over
    and over and expecting different results each time. In backing
    Mister Bush, you are backing the same kind of high intensity,
    massive intervention that was Vietnam, that other recent slippery
    slope leading to genocidal application of massive firepower against
    civilians.

    When I left Vietnam, in 1967, after one year in combat, we Americans
    had killed 160,000 Vietnamese; 8 years later, when President Ford
    ended all the surges, we had killed over 2.5 million Vietnamese. I
    do not need to point out to such a student of history as you that
    most of these 2.5 million dead were civilians. It seems today that
    the only way to end this repeat of really bad history (our history)
    is to begin impeachment proceedings against the leadership that
    created this mess by recklessly disregarding this nation’s
    constitution.

    Have a nice day, roll up your sleeves and get right to work in
    speaking out in favor of impeachment proceedings for Mister Bush and
    Mister Cheney. Remember, impeachment is constitutional, endorsed by
    the founding fathers and necessary to end this senseless
    bloodletting. Never forget you all in Washington are either part of
    the cure or you all are the whole, damn problem!

  7. Put Impeachment ON The Table of the House Judiciary Committee

    This week Dennis Kucinich led an heroic effort to put the impeachment of Dick Cheney ON the table by requesting a floor vote on H.Res. 333. As expected, BushDemocrat Steny Hoyer moved to table the bill. And then all hell broke loose as 165 Republicans voted with Kucinich and 85 brave Democrats to force a debate on impeachment over the objections of Nancy Pelosi. To block that debate, Hoyer moved to send H.Res. 333 back to the Judiciary Committee, and this motion passed. Watch David Swanson explain the events to Paul Jay of The Real News.

    Kucinich is urging Judiciary Chairman John Conyers to start hearings immediately because Cheney is desperately manipulating the National Intelligence Estimate on Iran to justify a U.S. attack, just as he did with the pre-war NIE on Iraq. But Judiciary Democrats are deeply divided on impeachment, with Robert Wexler (FL-19) calling for immediate impeachment hearings, while fellow Palm Beacher Debbie Wasserman Schultz (FL-20), who is close to Speaker Pelosi, told Ed Schultz she adamantly opposes hearings.

    So what do we do next to move impeachment forward?

    Calling All Lawyers

    The American Freedom Campaign wants 1,000 lawyers to co-sign a letter to House Judiciary Chairman John Conyers and Senate Judiciary Chairman Patrick Leahy to launch hearings into the possibility that crimes have been committed by this administration in violation of the Constitution, federal statutes, and international treaties.

  9. Conyers Considers Cheney Impeachment Hearings

    On Thursday, Chairman John Conyers’ House Judiciary Committee held a hearing at which Attorney General Michael Mukasey said that he would not investigate torture or warrantless spying, he would not enforce contempt citations, and he would treat Justice Department opinions as providing immunity for crimes.

    None of this was new, but perhaps it touched something in Conyers that had not been touched before. Following the hearing, he and two staffers met for over an hour with two members of Code Pink and discussed activism and impeachment, including Congressman Robert Wexler’s proposal to begin impeachment hearings on Cheney.

    Conyers expressed his concerns about what might happen following an impeachment, the danger of installing a Bush replacement or losing an election. But he said he’s listening to several advocates for impeachment, including Liz Holtzman and David Swanson of Democrats.com. He hinted he could be swayed by a convincing argument, leaning out of his chair for dramatic effect.

    So let’s help Chairman John Conyers decide! We know Conyers agrees with all of us on the legal grounds for impeachment because he made this case himself in his 2006 book, “The Constitution in Crisis.” Where Conyers needs persuasion is on the politics of impeachment, so we have addressed his concerns here:

Tell him the hearings must be on impeachment because that’s the only way to force the White House to comply with Congressional subpoenas. The phone in his office was reportedly ringing once every second, 60 times per minute, all day long on Monday. Let’s ring it faster on Tuesday.
