How do we keep on the right side of Big Brother in Washington, DC?
In our [Dutch] foreign policy this question will play a role.
However, it should not in a question of criminal law.
In September 2006, 18 year old Josanne is raped in Arnhem.
The suspect is a United States soldier of the 82th Airborne Division, called “Tito” G.
Dutch prosecutors have made a deal with US authorities that this soldier will stand trial in the United States.
However, Josanne’s lawyer is afraid there will be no conviction.
He wants the United States to extradite the soldier to The Netherlands; and that he should stand trial in The Netherlands.
So does Josanne herself, interviewed in the program.
She told that 25 year old “Tito” had told her he had killed in Iraq and might do it again to her.
She felt extremely scared.
Today, she feels the rape destroyed her life.
She used to be happy and outgoing.
Now, she does not dare to walk outside the house on her own any more.
The lawyer said that in the US, people want to send the suspect to Iraq again, which would preclude him being punished.

I believe the soldier should be sent to the Netherlands to stand trial, how else will the victim testify, how will the community where the victim lives believe that justice has been carried out, regardless of the status of Forces agreements with NATO countries, this alleged crime deserves trial in the area where it occurred, not in the US by court martial, where the Army may chose to deploy the soldier back to Iraq and hold the court martial upon his return, by then witnesses forget, he may get wounded and a jury would feel sorry for him, or if killed in the war zone the victim is denied justice, as a disabled veteran, I feel he needs to be returned to Europe for trial immediately, US soldiers do not get a free get out of jail card because of combat duty.

I am ashamed that one of our soldiers acted as a raving dog. I believe he should be sent to the Netherlands to stand trial. It is only right. Do you have information on the soldier? We can put pressure on his Congressman and Representative to send him back for trial.

In september 2006 wordt de 18-jarige Josanne in Arnhem verkracht. De verdachte is een Amerikaanse militair van de 82e Airborne Divisie, “Tito” G. genaamd.
De Nederlandse justitie heeft met de Amerikaanse autoriteiten afgesproken dat deze militair in de Verenigde Staten berecht zal worden. Maar de advocaat van Josanne is bang dat er van een veroordeling niets terecht komt. Hij wil dat Amerika de militair aan Nederland uitlevert en dat hij in Nederland berecht wordt.
Advocaat Peters krijgt hierbij steun van het SP-kamerlid De Wit: “Nederland is voor de zoveelste keer weer te slaafs met het uitleveren van verdachten aan Amerika. Dit kan je het slachtoffer niet aandoen”.
Tijdens de herdenking van de Slag om Arnhem, oktober vorig jaar, wordt Josanne na een avondje stappen verkracht. Na drie dagen voorarrest stemt het ministerie van Justitie in met een verzoek van het Amerikaanse leger om G. over te brengen naar de VS. De zaak is nu in de VS in onderzoek maar of er een berechting zal volgen, is onzeker. Advocaat Peters twijfelt of er daar ooit een eerlijk proces komt: “De twijfels zijn gebaseerd op de intimiderende wijze waarop Josanne benaderd wordt door de militaire autoriteiten. We hebben vernomen dat de verdachte uitgezonden gaat worden naar Irak, waardoor hij sowieso weg is. Dat geeft nog meer redenen om te twijfelen aan de goede afloop van die procedure”.
Nederland mag volgens een NAVO-verdrag de militair uitleveren. Maar advocaat Peters zegt in NOVA dat Justitie in dit geval veel te kort door de bocht is gegaan en van het verdrag kan afwijken: “Omdat het een bijzonder geval betreft. Het slachtoffer mag niet de dupe worden van die onzekere Amerikaanse rechtsgang. En die ruimte biedt het verdrag ook. Bij de Nederlandse rechter heb je zekerheid”.
“De Amerikanen geven het in de mails die we hebben ontvangen zelf al aan dat dit een politiek zeer gevoelig zaak is. Minister Hirsch Ballin zal moeten kiezen voor een Nederlands meisje dat verkracht is of voor de goede verstandhouding met de Amerikanen”, aldus Peters.
Jan de Wit van SP: “Er wordt door Nederland wat te gemakkelijk aangenomen, dat wanneer Amerika verzoekt om uitlevering, het dan wel zal kloppen. Ik wil van de minister weten wat hij gaat ondernemen om er voor te zorgen dat de berechting daar niet door gaat en dat de berechting alsnog in Nederland plaats gaat vinden”.
De Amerikanen willen Josanne vrijdag voor het eerst horen, maar daar wil ze niet aan meewerken. De Amerikaanse ambassade laat weten dat de aantijgingen “serieus” worden bekeken, en dat het militaire onderzoek nog loopt. Het Nederlandse ministerie van Justitie zegt niet in te gaan op individuele zaken.

The rape of Josanne was even more devastating than usually, because that soldier was a “guest of honour” in commemorating the battle of Arnhem in 1944. So much more unexpected and shocking.
However, that soldier was from the Iraq war. A war completely lacking the liberation side which there had been to the second world war in the Netherlands in 1944.
